Introduction
DiWi Agcency (hereinafter: “we”) process personal data of our customers, prospects, and other contacts. We do this to help our customers as effectively as possible and to achieve our objectives. In this privacy statement, we explain why and how we process your personal data. We do not have a Data Protection Officer (DPO), but we are happy to assist you with your questions. Who are we?
We are DiWi Agency: a creative media agency located in Rotterdam & Breda, the Netherlands. This privacy statement applies to all our processing activities – even if we process personal data together with other parties (for example, in the case of a mailing campaign).

Which personal data do we process?
We process the following personal data: First and last name, address, city, phone number, gender, email address, payment details, areas of interest (for example, 'legal' or 'search'), job title, photos, contact history, IP address, social ID, cookie ID (read more about cookies in our cookie policy), and browsing behavior.

Why do we process personal data?
We process personal data for the following purposes:

  1. Legal Obligations
    A small part of our processing is legally required. This primarily involves personal data needed to fulfill our tax obligations. However, it may also be that we process personal data in the event of emergencies at DiWi Agency. We also collect personal data from employees to, for example, enter into a contract and manage payroll administration.

  2. Customer Administration and Services
    In our customer administration, we keep track of which companies are current or past customers of DiWi Agency. For contact persons, we maintain personal data, such as contact details, to reach you. We also keep minutes of any meetings in our CRM system Notion. These minutes may contain personal data. We communicate with our customers through various channels, for example, by phone, email, and WhatsApp. To enable this, we also process personal data.

  3. Newsletters and Mailings
    To keep companies informed about important developments in the industry, we occasionally send out mailings. Sometimes these are personalized and sometimes not. If you no longer wish to receive mailings, you can always unsubscribe from the email.

  4. Reviews and Quotes
    To create a quote or review (for example, an SEO review), we process personal data such as contact details.

  5. Marketing
    We naturally want to showcase our strengths and attract new customers. Our most trusted channel to achieve this is (you guessed it) online marketing. To engage with potential customers and maintain this contact, we process personal data.

    For DiWi Agency’s campaigns, we process personal data such as your IP address, cookie ID, social ID, and/or your browsing behavior. We only do this when you give us permission through our cookie notice. The goal is to display relevant advertisements to you at the right time and place.

    We cannot see who you are or which company you work for unless you provide this information, for example, to conduct a Google Ads review.

    We also use so-called custom audiences on various social media platforms. This means, for example, that we recognize you have visited our website. Subsequently, we send a highly relevant advertisement through a medium like Facebook or LinkedIn. We never share personal data with third parties if you opt out in our cookie notice. Retargeting website visitors is otherwise called remarketing 😉

    It may happen that you still see a DiWi Agency advertisement after unsubscribing. This occurs if you fall into the general audience that we target our advertisements at. The audience we focus on consists of DMUs (Decision-Making Units) and marketing employees of ambitious and rapidly growing companies.

  6. Improving Our Website
    To increase the conversion rate of our website, we process personal data. For example, we process click behavior and the anonymized IP address. This allows us to see which pages, texts, and images you find appealing and which we need to improve. This way, we enhance the performance of our website.

  7. Rights of Data Subjects
    Under the GDPR, everyone has certain rights. We strive to comply with these. To exercise your rights, you can contact us via info@diwiagency.com. Below are your rights:

    • Information and Access: You can see which personal data we process about you. We are happy to tell you more about 'how and why' we process that data.

    • Rectification: If you believe we have incorrect data about you, let us know, and we will correct it.

    • Right to be Forgotten: You can have the personal data we hold about you deleted. It may be that we still need to process that data for other purposes (such as administration or deduplication).

    • Restriction: If you believe we are processing your personal data unlawfully or incorrectly, you can have that processing restricted.

    • Objection: You can object to the processing of your personal data. If it's for marketing purposes, we will cease that processing as soon as possible.

    • Data Portability: This is a new right under the GDPR to transfer your personal data. If you wish to exercise this right, please contact us.

  8. Retention Period
    We do not retain personal data longer than necessary.

  9. Legal Bases for Processing
    As explained above, we process data to fulfill a legal obligation, to perform our services, to maintain comprehensive HR policies, and to pursue DiWi Agency’s legitimate interests: achieving our objectives. Finally, we process some data with your consent: this mainly involves online tracking methods.

  10. Third Parties
    For the execution of our services, we engage service providers. These are not 'third parties' but processors. For example, we collaborate with the following suppliers:

    • CRM software from Notion

    • Accounting program MoneyMonk

    • Website statistics from Google Analytics

    • Usability insights with Hotjar

    • Call-tracking with Cookie

    We have concluded data processing agreements with these processors to ensure they act in accordance with GDPR guidelines. Sometimes, we are also legally required to provide personal data to third parties, such as the Tax Authorities.

    On DiWi Agency’s websites, there may sometimes be references to other organizations' websites. These can, for example, be source citations in our blog articles.
